Terms of Service

By accessing or using StreamFluent.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including visitors, free-tier users, and paying subscribers. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

StreamFluent provides an AI-powered live streaming platform that offers real-time voice dubbing, multilingual captions, and multi-destination streaming distribution. The Service includes a web dashboard, OBS integration plugins, and related APIs.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of material changes.

To access most features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with others
• Notify us immediately at support@streamfluent.ai of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these Terms.

Plans

StreamFluent offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis as selected at checkout. Plan details, pricing, and feature availability are described on our Plans page and may change with notice.

Payment

Paid subscriptions are processed via Stripe. By providing payment information, you authorize us to charge your payment method for recurring subscription fees. All fees are in US Dollars unless otherwise stated.

Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by applicable law. If you believe you were charged in error, contact support@streamfluent.ai within 30 days.

Price Changes

We reserve the right to change subscription pricing. We will provide at least 30 days' notice of price changes via email before they take effect. Continued use of the Service after the effective date constitutes acceptance of the new pricing.

Taxes

Subscription prices are exclusive of applicable taxes. You are responsible for paying all taxes associated with your use of the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Stream, transmit, or distribute content that violates any law or third-party rights
• Stream content that is defamatory, obscene, harassing, threatening, or hateful
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to any part of the Service or related systems
• Interfere with the operation or stability of the Service
• Use the Service to distribute spam, malware, or other harmful content
• Resell, sublicense, or commercially exploit the Service without our prior written consent
• Use automated scripts or bots to access the Service in ways that could harm it
• Circumvent any usage limits, technical restrictions, or geographic restrictions
• Impersonate StreamFluent or any other person or entity

Violation of these acceptable use rules may result in immediate suspension or termination of your account without refund.

You retain ownership of all content you stream through the Service ("Your Content"). By using the Service, you grant StreamFluent a limited, worldwide, royalty-free license to process, transmit, and temporarily store Your Content solely as necessary to provide the Service.

You represent and warrant that:

• You own or have the necessary rights to stream Your Content
• Your Content does not infringe the rights of any third party
• Your Content complies with the terms of service of any destination platforms you stream to
• You have obtained all necessary licenses for any music, video clips, or other third-party material included in Your Content

StreamFluent is not responsible for any content you stream through the Service. You are solely responsible for ensuring your streams comply with all applicable laws and platform policies.

The Service, including its software, design, logos, trademarks, and all content created by StreamFluent, is owned by StreamFluent and protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described herein. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software.

The StreamFluent name and logo are trademarks of StreamFluent. You may not use them without our prior written consent.

The Service integrates with third-party platforms and services, including streaming destinations (Twitch, YouTube, Kick, etc.), payment processors (Stripe), and AI providers. Your use of these services is governed by their respective terms and privacy policies.

StreamFluent is not responsible for the availability, accuracy, or content of any third-party services. We do not endorse any third-party products or services referenced on our platform.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

StreamFluent does not warrant that: (a) the Service will be uninterrupted or error-free; (b) the AI dubbing will be perfectly accurate in all languages; (c) the results of using the Service will meet your requirements; or (d) any errors in the Service will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STREAMFLUENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

STREAMFLUENT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO STREAMFLUENT IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless StreamFluent and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

You may terminate your account at any time by contacting support@streamfluent.ai or using the account deletion option in your settings.

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or if we have reasonable grounds to believe your use of the Service poses a risk to StreamFluent, other users, or third parties.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will remain in effect.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or confidentiality violations. You waive any right to a jury trial or to participate in a class action lawsuit.

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service at least 7 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.
